Recent Update for Fairfax Homeowners
If you live in the City of Fairfax, there is exciting news. As of July 28, 2026, the City now allows detached Accessory Dwelling Units (ADUs) in addition to attached ADUs. Previously, homeowners could only build an ADU that was connected to the primary residence.
Detached ADUs are now permitted in the City's RL (traditional single-family detached homes), RM (duplexes, townhomes, or small multi-family layouts), and RH (multi-family complexes, apartment buildings, and condominium) zoning districts, provided they meet local requirements for setbacks, building height, and parking. Properties with an ADU must also provide a minimum of two off-street parking spaces.
